This Disclaimer applies to acesba.com and to every report, template, workbook, guide, kit, article, calculator and workshop provided by ACW & Associates LLC under the ACESBA name (the “Services”). It forms part of our Terms of Service.

1. Not a lender, broker or government agency

ACW & Associates LLC is a private company providing education and loan-preparation tools. We are not a lender, loan broker, loan packager, lender service provider or agent of any lender, and we do not make, arrange, approve or guarantee loans. We do not receive referral fees or other compensation from lenders.

We are not affiliated with, endorsed by or acting on behalf of the U.S. Small Business Administration (SBA) or any other government agency. The SBA does not charge for applying for its programs, and its free resources are available at sba.gov and through SBA resource partners such as SCORE, Small Business Development Centers and Women’s Business Centers. You do not need to buy anything from us to apply for an SBA-guaranteed loan. “SBA”, “7(a)”, “504” and other program names are used only to identify the government programs our content describes.

2. Readiness scores are educational estimates

The SBA Readiness Report is generated automatically from your own answers, which are not verified, and from our reading of SBA program rules and common lender practice. It is not a loan decision, pre-qualification, pre-approval, credit decision, eligibility determination or offer of credit. Lenders and the SBA apply their own criteria, review your documents and credit, and may reach a different conclusion. A high score does not mean you will be approved, and a low score does not mean you will be declined.

3. No guarantee of outcome

We do not guarantee that you will obtain a loan, any particular amount, rate or terms, or a decision within any time frame. Lending decisions depend on many factors outside our control, including information you provide to the lender and the lender’s own policies.

4. Not legal, tax, accounting or financial advice

The Services provide general educational information and tools. They are not legal, tax, accounting, investment or financial advice, and using them does not create an attorney-client, accountant-client, fiduciary or advisory relationship. Decisions about borrowing, business structure, taxes, valuations, acquisitions and contracts should be made with a licensed attorney, certified public accountant or other qualified professional who knows your circumstances.

5. Credit education, not credit repair

Where our content covers credit, it is educational. ACW & Associates LLC is not a credit repair organization, does not offer credit repair services, does not contact credit bureaus or creditors on your behalf and does not promise to change your credit score or remove information from your credit report.

6. Templates, workbooks and examples

• Our templates and workbooks are not official SBA forms and do not replace any form required by the SBA or a lender. Where an official form exists, such as SBA Form 1919 or SBA Form 413, you must complete that form; our materials help you prepare for it.
• You are responsible for the accuracy and completeness of everything you enter in our templates and submit to a lender. Knowingly making a false statement to obtain a federally guaranteed loan is a federal crime.
• Calculations in our workbooks depend on the figures you enter. Review results before relying on them.
• Completed examples use fictional businesses, people and figures for illustration only. Any resemblance to an actual business or person is coincidental.

7. Program rules change

Our content is prepared from SBA Standard Operating Procedure 50 10 8 as amended by SOP 50 10 8.1, the Code of Federal Regulations and other published SBA guidance in effect when each item was last reviewed, and each product file carries a version number. SBA programs, loan limits, fees, eligibility rules and lender requirements change, sometimes with little notice, and individual lenders may apply stricter requirements. Confirm current requirements with your lender or at sba.gov before relying on them.

8. Calculators and figures

Payment estimates, loan calculators and example figures are approximations for planning only. Actual rates, fees, payments and terms are set by your lender.

9. Third-party links and information

The Services link to and cite third-party sources, including sba.gov and other government websites. We do not control those sources and are not responsible for their content, accuracy or availability.

10. Testimonials and results

Any description of a customer’s experience reflects that customer’s individual circumstances and is not a promise or typical result.

11. Limitation of liability

To the fullest extent permitted by law, ACW & Associates LLC is not liable for any loss arising from your reliance on the Services, including a declined or delayed loan application. Our full warranty disclaimers and limitations of liability are set out in our Terms of Service.
